Malaysia to Have Hanging Judges Next?
Today’s article in the NST about the judiciary to not allow technicalities to cause cases to be dismissed should be cause for concern.
It could result in the judiciary making decisions that are outside the scope of their powers and it appears that the AG is going to just allow the judges to take control of anything that is not done according to rules and regulations.
We know that the power of judges were severely curtailed during the 1988 judicial crisis but I do not think this apparent turnover by the AG will serve justice overall.
All cases that are heard before the courts have qualified lawyers and trained prosecutors whom I expect should be well versed in all the tactics that can be used in the court room drama. It is up to the players to make full use of all that the laws allow.
If one team is losing because they did not know all the intricacies of the law, we cannot have the referee deciding the outcome of the drama.
